I submit this affidavit to Anheuser-Busch, LLC (“A-B”) with the understanding that it will be relied upon by A-B to determine whether I am entitled to receive the prize which may be awarded to me in the Promotion. IT IS UNDERSTOOD THAT FAILURE TO RETURN THIS EXECUTED AFFIDAVIT WILL RESULT IN THE FORFEITURE OF MY PRIZE.
I understand that the Promotion includes the following prize: Two (2) tickets for winner and one (1) guest to the 2023 MLB All-Star Game presented by Mastercard scheduled to be played on July 11, 2023 in Seattle, Washington. Winner’s one (1) guest must be twenty-one (21) years of age or older. Game date is subject to change. Seating assignments to be determined by Sponsor, in Sponsor’s sole discretion, and subject to availability and change. Travel and lodging not included. Air transportation, ground transportation, accommodations, meals, gratuities, personal purchases and all other expenses not specified herein are solely the responsibility of the winner. If winner cannot accept the prize as specified, prize will be forfeited and will be randomly awarded to an alternate potential winner (time permitting). Approximate Retail Value is $600.00. Any difference between any stated value and actual value will not be awarded.
Use of any Major League Baseball game, event, exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see https://www.mlb.com/all-star/tickets/terms-and-conditions for details. Seat locations at the game, event, exhibition and, unless otherwise stated in the prize description, exact game, event, exhibition date shall be determined in the sole discretion of Sponsor. Each winner’s guest must be twenty-one (21) years of age or older. Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the applicable Major League Baseball Club, as applicable, and may be subject to change. The terms and conditions of the game/event/exhibition tickets awarded as part of the prize will govern in the event a legal game, event or exhibition, as defined by Major League Baseball, is not played or held, as applicable, due to weather conditions, an act of God, an act of terrorism, civil disturbance or any other reason. Winner and his/her one (1) guest agree to comply with all applicable ballpark and venue, as applicable, regulations in connection with the prize; see mlb.com/ballpark for details. Sponsor and the applicable MLB Entities reserve the right to remove or to deny entry to the winner and/or his/her one (1) guest who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Sponsor and the MLB Entities will not be responsible for weather conditions; acts of God; acts of terrorism, civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition. Major League Baseball game, event and exhibition tickets awarded as prizes may not be resold or offered for resale or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the game, event or exhibition tickets.
If Sponsor so elects, potential winner and one (1) guest may be required to submit to a confidential background check. Such background check may include (but is not limited to) investigation of criminal, sexual offenses, or other arrest or conviction record, and any other factor deemed relevant by the Sponsor to help ensure that the potential winner and one (1) guest will not bring the Sponsor or the MLB Entities into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Sponsor or any MLB Entity. If requested, the potential winner and one (1) guest agree to sign waiver forms authorizing the release of personal and background information. In the event of noncompliance, to be determined at the sole discretion of Sponsor, prize will be forfeited and will be awarded to an alternate winner (time permitting).
I have read and complied with the Official Rules of this Promotion and agree to be bound by them. As stated in the Official Rules, I understand that all applicable federal, state and local taxes, if any, and any expenses not specified therein, are solely my responsibility. I accept sole responsibility as the prize winner. I also understand that the fair market value of the prize is $600.00 and I shall be responsible for reporting this amount on all applicable tax returns. A-B may issue a 1099 form to me and to the federal government for tax reporting purposes.
In accordance with the Official Rules, I understand that no substitution of prizes is offered, that no transfer of prizes to a third party is permitted, and that non-cash prizes may not be redeemed for cash value.
On behalf of myself, my heirs, executor, administrators and assigns, I hereby release and forever discharge A-B, its corporate parents, subsidiaries, related and affiliated companies; alcohol beverage distributors and retailers; advertising, promotional and judging agencies, and the officers, directors, agents and employees of each (collectively, “Releasees”) from and against any and all liability, claims demands or actions of any kind whatsoever for personal injuries, including death, damages or losses to persons and property which may be sustained, directly or indirectly, as a result of my receipt, use or ownership of any prize awarded to me in connection with this Promotion, or while traveling to, preparing for, and/or participating in any prize-related activity, whether caused by the negligence of the Releasees or otherwise (except for gross negligence or intentional torts).
Furthermore, I hereby agree to permit A-B to use my name, voice, picture or other likeness for advertising, marketing, public relations or other promotional purposes in connection with this promotion or as otherwise determined by A-B and without further compensation therefor.
I understand that any prize I am awarded may be forfeited if any statement made herein is false.
